Information on the temporary protection status for people fleeing the war in Ukraine

The Ministry of Foreign and European Affairs and the Ministry of Labour, Employment and the Social and Solidarity Economy wish to provide information on the temporary protection status, in particular regarding the procedure to follow and the rights conferred.

The temporary protection status is a specific protection status activated at European level for persons having fled the war in Ukraine. It is available to persons who resided in Ukraine before 24 February 2022 and who arrived in Luxembourg since 24 February 2022, or shortly before.

It applies to Ukrainian nationals and their family members, but also to nationals of third countries other than Ukraine who have resided in Ukraine, if they are unable to return in safe and durable conditions to their country or region of origin.

Applications for temporary protection must be submitted to the Directorate of Immigration of the Ministry of Foreign and European Affairs. The processing of applications started on 10 March 2022. It should be noted that the persons concerned cannot spontaneously present themselves at the premises of the Directorate of Immigration but only by appointment. It is not necessary to contact the Directorate of Immigration to request such an appointment. The appointments will be allocated, as and when required, to persons who have notified their presence in Luxembourg.

The temporary protection status confers on the persons concerned the right to work in Luxembourg. The beneficiaries of temporary protection are exempted from applying for a temporary work permit and can therefore freely access the Luxembourg labour market without the need for a specific permit, for as long as their temporary protection certificate is valid. Once they have been formally granted temporary protection status, the persons concerned can also register as job seekers with the National Employment Agency (Agence pour le développement de l'emploi - ADEM). Employers can contact ADEM, Employers Department, directly (+352 247 88000; employeur@adem.etat.lu).

The children under the age of 18 also have the right to access the education system under the same conditions as Luxembourg nationals. School attendance is compulsory between the ages of 4 and 16 years. Information on schooling for children aged between 3 and 19 is available from the SECAM-CASNA services of the Ministry of National Education, Children and Youth (English: +352 247 76570 / Ukrainian: +352 247 76976).

The beneficiaries of temporary protection have access to the material reception conditions of the National Reception Office (ONA), which include housing, food and clothing support, as well as a monthly allowance and access to medical care.
